Sli\u010dne presude doga\u0111aju se sve \u010de\u0161\u0107e diljem Europe u posljednje vrijeme: pro\u0161le srijede \u017dalbeni sud u Amsterdamu <a href=\"https:\/\/eur01.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww2.staffingindustry.com%2Feng%2FEditorial%2FDaily-News%2FNetherlands-Court-of-Appeals-rules-Deliveroo-couriers-are-employees-not-self-employed-56714&amp;data=04%7C01%7Cljames%40etuc.org%7Cb055df9b76cd4d65951e08d8d4c924ca%7C7a57d45075f34a4da90dac04a367b91a%7C1%7C0%7C637493307669204701%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=aVAYIR8OU8lBGe5tsUOdntAj4CNRlidKdBsI4isGEeU%3D&amp;reserved=0\" target=\"_blank\" rel=\"noreferrer noopener\">presudio<\/a> je protiv Deliverooa, odnosno donio presudu da su dostavlja\u010di hrane zaposlenici i da ih tako treba tretirati.<\/p>\n\n\n\n<p>To je tre\u0107i sudski poraz za Deliveroo u posljednja dva mjeseca: u \u0160panjolskoj je nedavno <a rel=\"noreferrer noopener\" href=\"https:\/\/www.bilten.org\/?p=36413\" target=\"_blank\">presu\u0111eno<\/a> da Deliveroo mora platiti 1,3 milijuna eura u socijalnim doprinosima zbog 748 la\u017eno samozaposlena dostavlja\u010da. U Italiji, Sud u Bolonji je presudio u korist dostavlja\u010da koji su tu\u017eili tvrtku zbog nepravednog postupanja &#8220;Franka&#8221;, algoritma Deliveroo-a, prema radnicima koji su sudjelovali u \u0161trajku ili bili na bolovanju, na na\u010din da im je ograni\u010davao smjene nakon izbivanja s posla. Zbog ovog trenda neke platforme su po\u010dele samovoljno nuditi svojim dostavlja\u010dima ugovore o radu, \u0161to dotad nije bila praksa: kompanija Just Ear u Francuskoj planira zaposliti 4.500 dostavlja\u010da u 30 gradova do kraja godine. Tako\u0111er, sindikati su uspje\u0161no ispregovarali kolektivne ugovore za dostavlja\u010de u Danskoj, Austriji i \u0160vedskoj.<\/p>\n\n\n\n<p>Europska komisija \u0107e sutra pokrenuti savjetovanje o &#8220;radnim uvjetima platformskih radnika\u201c, a Europska sindikalna konfederacija (ETUC) smatra da ovi pozitivni primjeri ukazuju na jasnu potrebu za zakonskom regulacijom prava platformskih radnika <a rel=\"noreferrer noopener\" href=\"https:\/\/www.etuc.org\/en\/pressrelease\/eu-action-needed-after-uber-deliveroo-court-defeats\" target=\"_blank\">na europskoj razini<\/a>. Takve presude, smatraju u ETUC-u, ponekad samo donose pravdu za pojedince ili manje skupine radnika\/ica, dok platforme nastavljaju iskori\u0161tavati milijune drugih radnika. Zato je potrebno promijeniti pravila na europskoj razini, i \u0161to je jo\u0161 va\u017enije, zaustaviti \u0161irenje tog \u0161tetnog modela na druge usluge ili sektore \u2013 kako je izjavio Ludovic Voet, tajnik Europske sindikalne konfederacije: &#8220;Ne \u017eelimo da do\u0111e do toga da se moramo boriti za prava Uber voza\u010da hitne pomo\u0107i ili Uber medicinskih sestara. (\u2026) U posljednjem desetlje\u0107u platforme su iskori\u0161tavale rupe u zakonu o radu kako bi ostvarivale velike profite i izbjegle obavezu davanja ugovora radnicima uz odgovaraju\u0107e pla\u0107e i radne uvjete. To nije nepravedno samo prema radnicima, nego i prema velikoj ve\u0107ini poduze\u0107a koja igraju prema pravilima, kao i prema gra\u0111anima koji ovise o dobro financiranim javnim uslugama.&#8221;<\/p>\n\n\n\n<p>ETUC zahtijeva od Europske unije da, po\u010dev\u0161i sa sutra\u0161njim savjetovanjem o pravima platformskih radnika, uspostavi pravni okvir za poslovanje platformi koji \u0107e biti uskla\u0111en s radni\u010dkim pravima, umjesto da se (kao \u0161to je trenutno slu\u010daj) poslovni model platformi temelji na smanjenju tro\u0161kova rada i prebacivanju poslovnog rizika na radnike.
